Help Lynch Family Recover


A question for the US presidential candidates and everyone else who may be interested

Help! Elderly widow imprisoned in Montgomery nursing home; son seeks support to help recover from tragedy.

My dear mother, La Faye S. Lynch, has been imprisoned in a nursing home in Montgomery, Alabama, the same city known for incarcerating Rosa Parks when she refused to sit at the back of a bus, an action which resulted in a bus boycott and launched Rev. Martin Luther King, Jr. to national prominance as the leader of the Civil Rights movement.

Now another travesty of justice has occurred in Montgomery. La Fays S. Lynch, widow of Lt. Col. Leonard P. Lynch, has been locked away in a nursing home where she will likely remain until the day she die. Is matters not that she has a loving and caring son; all that matters is that she has a guranteed income from the Department of Defence, VA and Social Security such that the judge, the lawyers and the nursing home can all profit from financially raping and robbing her. Love has been taken out of the equation by a corrupt and unjust system, and this is allowed because after all, the general public does not care about the elderly and the institutions which exist to provide care for the elderly in Alabama have a great deal of experience in how to go about gaining power and control over those who have become incapacitated.

The elder care system in Alabama is in a shambles. In October of 2003, some two weeks after Lynch entered Crowne nursing home, Alabama Medicaid Agency cut nursing home eligibility and prescription drug coverage to help shave about $120 million in costs during the budget year that starts Oct. 1. Hence the alarm was sounded and nursing homes knew that to survive they needed to keep everyone admitted for rehabilitation and milk them dry of their benefits. That's exactly what happened to Lynch. After her son made a review of nursing homes in Montgomery and arranged her to be transferred to Tyson nursing home (later renamed Golden Living Center), administrators at Crowne asked the Montgomery County Probate Court to stop her trasfer. Judge Reese McKinney, Jr., ordered that Lynch not be moved and remain at Crowne until after a hearing with respect to appointment of a guardian/conservator. The result of that hearing was that Lynch was made a ward of the State of Alabama.


Lynch is a nursing home prisoner, a virtual slave of a corrupt system.

In 1995 via a Durable Power of Attorney Lynch had specified that she wanted her youngest son, Terry, to be her guardian/conservator. However, in Alabama citizens cannot specify, designate and appoint their own guardian/conservator. Probate judges, the same people who administrate auto tag licenses and other property, have the power of God in this respect. Hence without even hearing from Lynch's private doctors or having her present in court, Reese McKinney Jr., made her a ward of the state of Alabama, appointing perfect strangers to be her guardian/conservator, an action which represents a high degree of corruption, given the courts, the lawyers and the nursing home would highly profit form this action and it certainly did not provide Lynch with the best health care available in the area.

Lawyers appointed by the court to represent Lynch then turned around and sued the one person who had acted to save her save her life on several occasions, her youngest son, the very person she has designated to be her guardian/conservator. Lynch had enjoyed a very good relationship with her youngest son and for court appointed lawyers to do this was foolish, irresponsible and negligent. Such action represent an extreme form of corruption, the destruction of families by the court and extreme greed and exploitation by the judges, lawyers and others who participated in this action and/or may have profited. To do such a terrible thing to the one person who helped care for his elderly mother amounts to utter corruption, if not insanity!

Obviously greed driven by a lack of funding and need to do anything to survive was the motivation behind Lynch's virtual imprisonment. She is now essential a slave of the state, not a ward, but a slave! This is because those whith power and control over here life have essentially exploited her in a way that has hurt her more than anything else they could have possibly done! For when you act so as to destroy that deep and bonding love and care which exist between family members, then you commit a crime against humanity and God, a crime that certainly guranteed all who have participated will one day burn in Hell.

Is there any possibility or redemption or salvation for such sinners? That is not a question which this author can answer. However, he asks everyone who is in sympathy to help. Here are some actions you may take:

Recovery

Alert! Please help! Funds are needed to recover from this great tragedy. My mother, La Faye S. Lynch, had a stroke and now has dementia. She has been declared a ward of the State of Alabama against her will. This was done by Montgomery County Probate Judge Reese McKinney, Jr. This is the same judge that was sitting on the Board of Directors of Jackson Hospital when my mother was taken to the emergency room where she was infected with bottle fly maggots which were contaminating that facility!


Lynch is a virtual prisoner in a Montgomery, Alabama nursing home.

It is my belief Judge Reese McKinney, Jr. acted to imprison my mother and take away all my powers with respect to acting as her attorney in fact to protect Jackson Hospital and enable the operation of a corrupt, under funded elderly care system. This same judge appointed perfect strangers as my mother's guardian/conservator, going against her wishes and directives, which was an insult to her intelligence in nominating me for that postion, given I am an intelligent person able to make sound and responsible decisions that are in the best interest of my mother's healt and welfare.

These actions by corrupt judges, lawyers and nurshing home administrators are a great tragedy and have caused loss of property, hurt, harm and emotional suffering. Thousands of dollars was lost trying to fight the ruthless, blood sucking corrupt lawyers of an under funded elderly care system. The way Lynch and her family have been treated by the courts of Alabama and the elderly care system is an outrage! Her youngest son is asking everyone who wants to offer their support in my fight agaisnt the corrupt elderly care system to please make a donation. Please look into your heart and help in the same way you would if it had been hurricane Katrina that wiped out the Lynch estate for certainly the evils done by man have caused as much damage! Champion A Cause

There are many ways that K9PAW designs may be used. Just wearing or displaying the design items helps raise awareness for that good cause you wish to promote. This is a way everyone who is a canine lover can be empowered to change the world and make it a better place. I Love Montgomery

In the many years that my family and I have lived in Montgomery we have contributed much to the community. My grandmother, Sue Lynch, worked at Rosemont Gardens for many years and helped provide service to members throughout the community in need of floral arrangements for Valentine's Day, weddings, funerals and other occasions. My father, Lt. Col. Leonard P. Lynch, was the transportation officer in charge of moving the troops who protected and secured the civil rights marchers during the original Selma-to-Montgomery march. My Mother, La Faye S. Lynch, has been a long time resident of Montgomery who cherishes the people of her adopted town. She now is a resident in room 13 at Crowne nursing home, having been made a ward of the state against her wishes and clear directives.

Montgomery has been good to me and my family so I want to give something back to the community and to the people of Alabama. Thus I've created a series of design items which will allow everyone to express pride, joy and love in their city and state. Letter to Church Members

Dear Church Members,

Life has its ups and downs and sometimes it gets the best of us. But together through helping each other and keeping faith in those values which we hold precious and share as a church family, we can always prevail.

It is with this in mind that I would like to share a rather sad story. My mother, La Faye S. Lynch, had a stoke and almost died. I prayed to God that she would live and His prayers were answered. Miraculously she regained consciousness and in response to my 911 call was rushed to the hospital. Now, almost a year and a half later, she is still recovering in room 13 at Crowne nursing home.

I would like to invite others to visit my mother as she is a wonderful and charming person. But unfortunately her illness was just the beginning of a tragic chain of events that has left my family in ruin.

After a struggle to have my mother evaluated by private physicians it was learned she had early signs of dementia, probably vascular dementia. This disease has no cure and very likely my mother will live and die at Crowne nursing home, which is not really the best place to spends one's last years.

Dementia is one of those diseases which is not very well understood and this results in a lot of prejudice being expressed toward those who have this condition. It also can result in family conflict, tearing families apart and destroying love relationships. It is very important to respond in such situations with love, kindness and understanding, rather than with anger, frustration or other forms of behavior which are unproductive and not expressions of love.

My mother, La Faye S. Lynch, is the daughter of a Methodist minister, Columbus Lafayette Sumner. He ministered in northern Alabama between 1917 - 1949. I'm sure if he knew his daughter were now confined like a prisoner in a nursing home which is almost as old as she is, separated from home and family, that he would not approve.

When I tried to have my mother transferred to a more modern facility where she could have access to better physical therapy and be followed by a geriatrics specialist, the nursing home asked the Court to intervene. As a consequence now my mother has been declared a ward of the State of Alabama and the love factor of the most trusted family members she wanted to have making decisions for her has been removed. This is quite like having the state take control of a church dictating what its minister and congregation must do. Yet in Alabama no citizen has a right to appoint their own guardian/conservator and the state can take away all one's rights, dignity and respect with a simple stroke of the pen.

This has had a serious impact upon my family income. Over $52,000.00 in income plus benefits is now under the power and control of non-family members. Now creditors will likely take away my home as I cannot afford the huge monthly payments along with all the other monthly bills. Even the City of Montgomery has threatened to put my home up for auction as I was not able to clean up quickly enough after hurricane's Ivan and Jeanne.

As the world contributes hundreds of millions of dollars to tsunami victims, my entire family and home is being destroyed, washed away as surely as if hit by a tidal wave. Yet not a cent is available to aid. This is the result of what I interrupt as a corrupt elderly care system and the Courts meddling in family affairs exploiting the elderly to rob their estates. In this regard I am trying to start a grass roots effort, the Elderly Rights Association, to inform the public about the corruption and exploitation of our elderly.

God answered my prayers and my mother did not die on the evening of August 28, 2003. I believe she lived because God has a plan. He wants everyone to see how our elderly are exploited by the State of Alabama and the corruption which exists in the elderly care system. He wants everyone who sees this injustice to come together and rectify a bad situation.

So now I would like to ask everyone who has a heart to help me. I would like to ask for your prayers to help my mother so she does not suffer. At time when I have visited her at Crowne she has complained of pain and suffering, which she had never experienced before. The doctor there will not talk with me nor involve me in my mother's health care plan as was my mother's written request. Basically the system has ignored what my mother wanted done and have taken power and control over her life to get all her money and assets.

Your prayers for my mother will certainly be appreciated. But I also need to ask for other forms of help. Unless I can raise about $100,000.00 my home is going to be taken away. I know that will please the Probate Court and the lawyers involved as they don't like having to deal with a son who loves his mother and fights for her rights every step of the way. So I'm asking for everyone who can to please help in whatever way you can, and especially to make a contribution to help Save My Home. I need to raise at least $100,000.00 to pay off creditors! Plus my mother is greatly in debt. I already spent over $20,000.00 of my own money to pay off a portion of her debts. Plus this has resulted in high legal bills and medical bills. The shock of seeing my mother's health deteriorate and not knowing what was wrong with her has caused me much suffering. It was a relief to finally get her diagnosed by Dr. Ben Wourters, a Montgomery area neurologist. But his orders are not being followed by Crowne, and she is in need of an MRI scan and perhaps other treatment that is being withheld from her because the Court has acted to appoint non-family members as her guardian/conservator. So the system has acted to remove the love factor which means my mother is at the mercy of a faithless, ruthless judicial system and an under funded elderly care system which has made her a prisoner, warehousing her in a small concrete block room until the day she dies!

My mother still owns a great sum and the Court appointed lawyers have neglected to deal with these creditors, so they are sending me all the bills. Apparently all her income and benefits are being used to pay her medical bills and her lawyers, leaving nothing else. The result is creditors circling like sharks, praying upon my mother and me, destroying my family.

It is not easy to ask for help. I am a very self reliant person and have never had to ask for such help in the past. Yet I believe God has a purpose in all things that He does. Perhaps His purpose is to bring together those who believe to show that miracles can be done, that no matter how bad things sometimes seem, there is always hope for those who pray and have faith in God.

Thus I'm asking all who share such faith to help in this time of need. Please contribute whatever amount you can to Save My Home that it is not washed away like a tidal wave as heartless and faithless creditors decent upon the estate of an old woman, her loving family and son, who sacrificed so much for her over the years, and now lives but that one son's prayers were answered.

This design was produced to celebrate our Moms and Dads as beautiful people! It is wrong that the courts would make second class citizens out of our Moms and Dads, out of the elderly! Every citizen should have a God given right to specify and appoint their own guardian and conservator. That right has been abused with respect to my mother and with respect to many Moms and Dads in Alabama and throughout our great nation. As our troops are fighting against terrorism in Iraq and around the world, here at home candy bar probate judges and greedy, corrupt lawyers are exploiting our Moms and Dads! Our elderly parents deserve better!

Our elderly parents deserve better treatment than to be warehoused in nursing homes. Certainly there are cases where the elderly have no family members left who love and care for them. But the case of my mother is not one of these. In her health care directives she specified that I be the family member to be consulted with regard to all matters related to her health and care should she ever become incapacitated. The Courts of Alabama have refused my mother's wish in this regard. Therefore they have done a great injustice to my mother and my family.

We must stop warehousing elderly Americans and look for better solutions to the problem of caring for our elderly parents and grandparents. To promote this idea I urge everyone who cares about the health and welfare, the rights and dignity of the elderly, to support a movement to secure the rights of elderly citizens that they may specify, designate and appoint their own guardian/conservator. Also I urge everyone to take up the call that we "Stop Warehousing Elderly Americans!"

By supporting this cause you will be helping all elderly people as well as yourself, for one day, God willing, we all will grow old. Unless we act now to secure our rights the Court may make us all wards of the state and lock us away to spend the final days of our lives in a small concrete block room of an antiquated nursing home, as has been done to my mother.
