My mother, La Faye S. Lynch, had and stroke in August of 2003, was hospitalized and subsequently transferred to Crown Nursing Home in Montgomery, Alabama upon the recommendation of her doctor. After this was done my eldest brother, Carl Gregory Lynch, acted to have her Power of Attorney revised and himself appointed her attorney in fact and executor of her estate. This was a violation of my mother's rights because she was not mentally competent at this time or since her stroke. After having this document declared void I was able to get my mother to see a nurologist who confirmed that she had dementia. The day after this diagnoisis Greg and his daughter kidnapped Larry, my brother who has mental retardation, and took him out-of-state to Lakewood, Colorado, where they later had a court in Colorado declare Greg and his wife as Larry's guardian/conservator.
I know as a fact this is NOT what my mother directed or wanted to have done. My mother wanted me to be Larry's guardian/conservator and she did NOT want Greg or his wife to have anything to do with Larry's care should she become incapacitated. This is why she appointed me her attorney-in-fact in 1995.
Greg's actions assisted by his daughter constitute a violation of my dear mother and Larry, a person with mental retardation. This is also a form of exploitation and may have also involved a federal crime of kidnapping.
Because I regard this as a crime of kidnapping and exploitation of the elderly and a person with mental retardation, I am taking action to forever nullify what Greg has done. I am in possession of my mother's Last Will and Testiment which I have shredded. Therefore my mother's wished will never be known and Greg will never be able to serve as an executor of my mother's estate to carry out whatever these wishes may have been. I will never reveal what those wishes were and this will in effect prevent Greg from being able to have power and control over my mother in death as he has attempted to do in life. I regard this as a form of justice and/or civil disobendience, such that the Probate Court in Montgomery, Alabama will not now be able to permit Greg to execute any provisions of my dear mother's Last Will and Testiment.

I have taken a photograph of my Mother's Last Will and Testament after it was shredded and placed in a vial. I have done this to symbolize that love is more powerful than hate, destruction, greed, jealosy or whatever other negative purpose or motivation my eldest brother was following when he tried to nullify my mother's Durable Power of Attorney and have himself appointed executor of her estate. It is my belief and opinion that Greg's actions were not motivate by love; that he does not love my mother, that he never loved any of his brothers and that he is an evil person, given the fact that he beat and bullied his siblings until they were teenagers.
Such a bully should not be the guardian/conservator of any person with mental retardation nor the executor of my dear mother's estate. I hope that by shredding my mother's Last Will and Testament I will have demonstated that life and love are more powerful forces than those of destruction. You see, without a document upon which to base any actions, all the court will have to go by is what people say. And I say that Greg with the aid of his daughter kidnapped Larry, that this is a felony and that my dear mother and Larry who are helpless people have been exploited.

This type of exploitation of the elderly and a person with mental retardation is an outrageous injustice. I am the only person who my mother wanted to have charge over her life and Larry's life should she become incapacitated. Because people took action to deny my mother's wishes in life, I have taken action to prevent them from exploiting her in death. Because I know what my dear mother's Last Will and Testament said, you can be sure that shredding that document does exactly what I have indicated.
It is shameful that any courts in America would permit such exploitation of the elderly and a person with mental retardation. Yet we live in a society where money is power and the person who pays a lawyer the most money can manipulate the court. This is the reality of our world. Yet it is also a reality that love exists and where there is love there will always be people who are more motivated by love than by money. Hence I destroyed my mother's Last Will and Testament that my eldest brother or others motivated by money and greed would never know what her wishes were. Only I know that as I am the only family member who truely loves my dear mother.
I place my mother shredded Last Will and Testament in a vial and took a photograph of it to create ART. I will now market that ART to generate money which only I will own, such that my mother's Last Will and Testament will only profit me and will not profit those who exploited her in life, who kidnapped Larry and exploited Larry. Thus symbolically I will be the only one to profit from my mother's Last Will and Testament!
The courts of Alabama may do whatever they want to do. It is my opinion that the courts of Alabama are corrupt and have participated in the exploitation of my dear mother. Therefore by shredding her Last Will and Testament and turning it into ART and marketing that ART, I have acted with civil disobedience to take the power away from the court, to turn corruption into justice through the creation of ART.
I believe that the pen in more mighty than the sword and that the creative process motivated by love can change the world for the better. I would like to ask everyone who agrees with me to support my actions by purchasing gifts and apparel based upon designs I have produced showing my dear mother's Last Will and Testament shredded in a vial entitled "In Memorium La Faye S. Lynch."
Although my dear mother did not die when she had a stroke in August of 2003, the woman I had known my entire life did die that night. She became unconscious and I prayed to God that she not die. It was indeed a miracle that she regained consciousness, but her mind was never the same. I believe God answered my prayer that certain revelations could be made which have forever changed my life. Thus I have created "In Memorium La Faye S. Lynch Last Will and Testament in a Vial" and will use whatever funds this work of ART generates to promote awareness with regard to abuse and exploitation of the elderly and people with mental retardation. This is what my mother would want and it is her true Last Will and Testament.
