This following letter has been posted to the Montgomery Advertisers and other media to educate, inform and enlighten the general public, urging that they petition state legislators to reform the law, such that each citizen may specify, designate, and appoint their own guardian/conservator.
Dear Judge Reese McKinney, Jr.
The order by Montgomery County Judge Reese McKinney, Jr., that my dear mother, La Faye S. Lynch, be made a ward of the State of Alabama, represents a miscarriage of justice and an exploitation of elderly Americans! This is an order which should not stand as it was based upon lies, lies and more lies!
The only facts which matter in this case are that I love my dear mother and have always acted in respect of her wishes and best welfare. I have endeavored to oppose those who sought to exploit her, those whom were motivated by greed and selfishness to stoop to vial acts of deceit, defamation and lies to make my dear mother a ward of the state of Alabama and a nursing home prisoner.
In Alabama no one can appoint their own guardian/conservator; you can only "nominate" persons for said appointment. When my dear mother appointed me as her attorney in fact in 1995, she did not know this; she designated me as her guardian/conservator for life should she ever become incapacitated. After she became ill others attempted to revolk her Power of Attorney and have themselves appointed as her attorney in fact and executor of her estate. Hence my dear mother's wishes and desires were not respected. Then these same people lied to the court, the result being that she was made a ward of the state. This resulted in a freezing of our joint bank account and subsequent loss of my home in Montgomery.
It is a vial act of corruption when instead of coming to the aid, help and assistance of the elderly, actions of the court, how every well meaning, should result in the expoloitaiton of the elderly. It is a fact that there is not enough money to provide care for the elderly, especially when they are made nursing home prisoners. Hence estates are raided, income is diverted, and families suffer. I have suffered greatly as a result of Judge McKinney, Jr.'s ignorant and foolish ruling making my dear mother a ward of the state of Alabama, as has she suffered beyond measure!
It is especially terrible that this was done as a result of a hearing where my eldest brother, Carl Gregory Lynch, who beat, bullied and abused his siblings from the day we were born, lied to the court. Greg also kidnapped his own mentally retarded brother, Larry Lynch. How could the court give this abusive person, who in my opinion is a pathological liar, the time of day, much less an ear? Court orders based upon lies and fraud should not stand, much less be respected by those who are aware of the nature of the lies. Such abuse, beating and bullying, as exhibited over and over by my eldest's brother, now has matured into abuse and exploitation of the elderly and incapacitated! For the court to believe his lies and do his bidding warrants my disrepect and denunciation of any related court orders. Hence I stand against such abuse and campaign to help others expose and act to stop those who would beat, bully and abuse their siblings, spouses or the elderly and incapacitated!
The people of Montgomery and of Alabama need to know that Judge Reese McKinney, Jr. is not God! In my opinion he is an example of blind justice gone amock, a soul darkened by those who have lied under oath and who has participated in the exploitation of my dear mother. The order that my dear mother be made a ward of the state of Alabama is not one that I can respect! This order was based upon testimony which included lies and the actions of an elder brother who committed fraud upon the court; the very same person who would have the court believe I am insane! But since when is it insane to love one's mother and to try to protect her from the abuse and exploitation of others?
I am an honest man and refuse to remain silent, even after the passage of some years. I am currently calling for the resignation of Judge Reese McKinney, Jr. I also urge the people of Alabama to reform laws with respect to appointing guardian/conservator, such that each citizen may specify, designate and appoint their own guardian/conservator. Moreover, I appeal to the people of Alabama to set my dear mother free. To keep her a nursing home prisoner is an act of cruelty and the inhumane treatment of the elderly, an act which involves exploitation of the elderly by those whom profit from said exploitation.
I hold everyone involved in the exploitaion of my dear mother as responsible for their acts; this includes those relatives, lawyers and judges who have enabled and empower said exploitation. I may not be in a position to fight you in court, given loss of my home and much other property, but I can speak out against your corruption and urge others to join with me that the system be reformed.
Thus I denounce the order issued by Judge Reese McKinney, Jr. declaring my dear mother a ward of the state of Alabama. This ruling was based upon lies and fraud that was committed by others to gain advantage, power and control; enabling them to profit at the expense of my dear mother. Should there be a God Almighty to do real justice, I pray that those who have acted to hurt, harm and exploit my dear mother be brought to justice -- else they can burn in hell for all I care!
Thus I curse Judge Reese McKinney, Jr., and urge the people of Alabama to join with me to sign a petition, to rectify and reform the laws in Alabama, that each person may appoint their own guardian/conservator. Let's all join together and petition that each citizen may appoint their own guardian/conservator. Unless this is done there will always be those who can lie, deceive and manipulate the court to exploit the elderly and incapacitated for their own selfish and greedy purposes.
