The purpose of this page is to educate and inform the public with regard to copyright issues and the creative process, to promote the freedom of speech and expression and make clear to all those concerned with issues related to creative process that any attempt to censor that process will be resisted and challenged.
On January 8, 2003, I received an e-mail from CafePress.com. The e-mail informed me that a complaint had been received about two of my designs shown below (See Fig.1 and Fig. 2). The complaint alleged that these designs which are my original creations and were published with my embedded copyright notice were a violation of the Digital Millennium Copyright Act ("DMCA").
Oh really? And just who do you think made these two heart designs? I suppose the next thing someone is going to be claiming is that my heart
does not belong to me!
Get real! All heart
designs that I have used were created from a unique heart template that I drew and cut myself without any reference to I
NY. In fact these designs were made as part of a series of state and other heart designs. Any resemblence to the I
NY is totally unintended, accidental and in the minds and imaginations of someone other than myself. Even this small heart
font was made from this original heart template shrunk down to 30 pixels x 30 pixels. Plus even this tiny heart contains a "TAL" watermark to identify it as an original design which I have associated with the World Peace Project. Any and all of my original heart
designs contain a copyright notice. Any resemblence or assoication with the I
NY trademark is not intended and I certainly did not copy that rather boring, ameturish trademark design.
Plus, the irony here is that this position paper would never have been produced or written if someone had not made a false claim that my heart
designs are not original and do not belong to me. So any ambiguity or confusion that results from the creation of this position paper written in defense of my original designs and concepts is the result of a false claim made against me and those responsible for making this false claim are the ones truly liable for any damaged this association has caused.
Throughout this position paper I even have used my own heart
font which gives notice when you hover the mouse over it on this page that this is the "TAL" heart font assoicated with the World Peace Project. The watermark sets this apart from anyother heart. Certainly I can use my own heart to say anything I want to say. And certainly I can use my own heart designs to promote any idea I want to promote. This is a freedom of speech issue, not a copyright infringment issue!
Who ever would think that they could own someone else's heart is crazy. This has to be the result of money grubbing lawyers and government agents. Sorry, but my heart
belongs to ME! I will NOT let anyone steal it! Nor will I let anyone suggest that my heart
does not belong to me. It's got my initials on it which should be enough to tell anyone it is TAL's heart, not their heart!
New York State Department of Economic Development (NYSDED) owns the copyright to I
New York. But they certainly do not own my heart
designs, not even this small
font. However, CafePress.com de-published my designs which had only recently been posted on the Internet and had not even sold a single item.
These two original heart
designs produced by EArts are alleged to be a violation of copyright held by the NYSDED. Could it be they don't want any mention of "traffic, noise pollution or rats?" Could it be my heart
designs are so new, original and represent such a great fortune that their censorship is desired simply so New York City or State can not have any competition in the heart
design market? This seems quite probably when you realize how unique and radically different, new and original my heart
designs are from anything New York City or State has made in the past.
These designs are NOT for sale and are for exhibit only! These original designs and slogans are Copyrighted 2003 by EArts. These designs are posted to illustrate the types of variations in heart designs and to inspire other creative artists and writers to make heart designs.

These designs were de-published and are NOT being used on CafePress.com. It is not worth my time and effort to contest this issue. Rather I directed CafePress.com to voluntarily remove these designs and told them I would just make new designs that will not be in dispute. However I think this is still a matter of censorship. After a review of registered trademarks at the United States
Patent and Trademark Office site on the Internet, it was learned that the designs in question certainly were not registered by the NYSDED. Although said party does own a specific design (see USPTO trademarks registration numbers 1542851;1555836;1558379, 1704940, 1701791,1805333Not for Sale

The permissibility of variations in the "I
NY" and "I
New York" themes becomes quite evident when one views other registered designs. Examples:
Certainly my heart designs have such a great difference that no one can confuse them with any registered trademark or design owned by NYSDED. Their designs are not nearly as appealing, attractive and creative as my heart
designs. Nor do these old and boring designs express the same ideas as my new, enlightening designs. Quite frankly I think the old, NYSDED designs are dull, boring and lack imagination. Someone else probably thinks the same thing and they probably want to get rid of my designs so they can make their own designs similar to my better designs and then claim ownership of them!
Thus this is clearly censorship by intimidation and making of a false claim that they own my original New York City and New York heart designs. My designs are much better than the boring ones that the NYSDED owns and their attempt to censor my designs is probably also motivated by the fact they recognize how good my designs are and they do not want them on the market. So to get rid of the competition they have made false allegations that my new, original, and very creative designs are a copyright infringement. That's not true and I regard the accusations as libelous for it attempts to defame me when all I have done is created new, original designs and slogans that are radically different from those which preexisted before I invented my new designs!
I informed CafePress.com early in the morning of January 9th, that my designs were my own original creations and that I was the copyright holder of my designs, that if Mangia Pizza Kitchen, Inc. could make a simple type font style variation of the theme "I Love New York" and add a different heart
design and the single word "pizza" that certainly my heart
designs which used entire phrases and short poems and were based upon an original heart
drawn and cut from a template of my own design and creation certainly were NOT a violation of the copyright registration held by NYSDED, that this was clearly a case of censorship, not copyright infringement.
Certainly the NYSDED does not want to promote the fact that New York City has problems with "traffic, noise and rats," as is expressed in one of my designs. The NYSDED wants only to promote one positive view of New York and New York City and their attack upon my design is an attempt to censor my freedom of speech and expression as a creative artist!
Plus this censorship issue takes upon a wider aspect when one realizes that just making false allegations caused me to loose the store sites on Cafepress.com. This essentially takes away my position to market these design items even though they do not represent an infringement upon anyone's copyright. These site positions on CafePress.com were first selected by me. No one else had previously reserved these stores. Therefore I have a first right to these site positions. Because the heart
designs I created and published at these sites were original creations significantly different in theme, concept, layout, type fonts, slogan and even the construction of the heart
, there is no reason to deny me these store sites on CafePress.com.
There can be thousands upon thousands of permissible and legal variations of a design concept, including heart
designs. Certainly I am involved in creating a whole series of original heart
designs for the various states, cities and countries. This is in congunction with the Support Ameirca campaign and the World Peace Project. To attempt to prevent the publication of my original heart
designs is to censor the creative process. That is unAmerican! That is unpatriotic! And that is illegal and a violation of my First Amendment rights to free speech!
Those who have attempted to censor my free expression have therefore violated my Civil Rights! I will not seek there permission to publish my own original heart
designs. These are my heart
and they do not belong to anyone else! They are my own original creations! Nor will I submit to their attempt to censor my original heart
designs. I certainly will NOT stop saying that New York City has a problem with "traffic, noise and rats!" These are problems the State of New York and the City of New York can not solve by censorship! They are problems which are going to require acknowledgment, effort and money to solve.
The City of New York, which is a great city and the focus of the world's attention after 9/11 must acknowledge the filth, congestion and pollution which they have and work to solve those problems, not by censorship of the original work of creative artists and writers, but by investing the time, money and energy into getting rid of the filth, noise pollution and even the rats and cockroaches which infest New York City!
I will not submit to the attempt by the State of New York or anyone else to censor my free expression! I think my heart
designs are so good that the State of New York or the City of New York should hire me to make them some new "I Love New York" or "I Love NYC" designs. I could easily produce a whole series of design variation for these people. But instead of seeing this potential and the millions of dollars that they could make marketing my designs, they want to censor them!
It is my belief that the creative process is what makes America the greatest nation on Earth! Our constitution guarantees the freedom of speech and says that Congress may make no law to abridge that freedom! Well that certainly applies also to the State of New York via the Fourteenth Amendment.
There are a million, million possible variations of any idea or concept. There are certainly millions upon millions of ways to make a heart
design, even heart
designs about New York City. The State of New York can not claim a right to all the possible variation of the theme "I
New York" or "I
NY," without seriously infringing upon the creative process and violating the basic right to freedom of speech all creative artists and writers enjoy. What they do own is their specific registered trademark designs, not my heart
designs.
Therefore I will maintain the publication of my heart
designs and seek to promote my heart
designs to the entire world through creative advertising campaign that foster peace, love and harmony among men. If the State of New York or their agents or representatives do not like this, if they want to censor everyone who has a heart, so they will be taking upon the whole world. And this issue certainly will attract the attention of the world press, at least if I have anything to do with it. Quite frankly, I will enjoy the fame, fortune and glory which shall come from such an attack upon my freedom of speech!
Position Paper Published by EArts and the Support America Campaign

I'm sure that if the State of New York does not like my heart
designs the City of New York is not going to like my Stop dumping on America designs and America the Beautiful campaign either. Sometimes you just can't please anyone. But if the New York is going to be dumping its garbage on America, citizens throughout the nation must take a stand against this form of environmental terrorism. Quite frankly our nation is going to be hurt as much or more than on 9/11 by a policy that permits New York City and other metropolitan areas to dump their garbage in our homeland!
When this position paper was first posted I had not yet received copies from CafePress.com of the contested design. When finally I received fax copies I was notified that the store in question was at the URL www.cafepress.com/ILoveNY2002. This is NOT a store that EArts produced. The store at this site did contain what appeared to be a copied design of the NYSDED's registered trademark so apparently a mistake had been made if someone thought that was an EArts store.
I maintain that my two designs, similar to those shown above in Fig. 1 and Fig. 2 are not a trademark infringement; nor are any of my other heart designs an infringement upon any registered trademark. My designs are so radically different, given the incorporation of a unique heart
, type style fonts, slogans and poems that there certainly would be no problem for me to get a trademark registration should I wish to do this. But it is easier to voluntarily agree to have the two disputed designs removed from CafePress.com and simply make new designs. In fact in the time that it took me to deal with this matter I could have made a number of new designs and started the World Peace Project to promote peace, love and harmony among all of humanity via my heart
designs.
Moral to the story is that if some big law firm, government agency or company tries to make a claim regarding original designs on CafePress.com, it is easier to just remove the designs and start from scratch to make some new ones. What bothered me most in this matter was how my original designs were confused with those at www.cafepress.com/ILoveNY2002. This is NOT a store belonging to EArts and I am not responsible for marketing the I Love NY trademark design on items in that store. Someone else established that store and if they are trying to associate my original heart
designs with this store, I'm sorry, it is NOT going to work! To make such an assoication would be libelous and a form of defamation, and perhaps even a form of identity theft if someone did this using my name, address or other readily known information. So if someone is trying to destroy my reputation using this tactic of on-line terrorism, they had better watch out! I'll get the District Attorney of my state to investigate them and file a fraud and defamation claim! My heart

Some two months after the New York State Department of Economic Development via CMG Worldwide began to harass me with respect to two original designs I had posted on CafePress.com, I received a second letter wanting an accounting of all items sold. I had thought this matter had been settled, given I had removed two designs. However upon preparing a reply, I discovered that someone had opened a series of stores on CafePress.com which featured I (heart) NY and other state designs. Remarkably this person put their I (heart) New York design on the URL that had previously belonged to me! Thus anyone looking into this matter would conclude that I had not complied with CMG Worldwide, giving the wrong impression that I was not being truthful. The person who did this, I contest, did so for the purpose of defamation. I have sense refered this matter to a private investigator and law enforcement agents associated with various ISPs to let them deal with the matter. Hopefully they will be making an arrest pretty soon.
As a result of this discovery I notified CafePress.com which gave me permission to add a design that did not have anything to do with New York at the URL http://www.cafepress.com/ilovenewyork. I prompty drew up the design below for posting that no one could use this URL in the future and help clear up this issue.
Of course the next thing you know those trying to pirate my art and casue defamation will steal this original Copyright Design, even though it is copyrighted by me.

These two designs reflect the complexity of variation which is possible to create using the above described technique and method for making original heart designs.
When you create original heart designs please avoid trying to make them similar to existing trademarks, especially to the I (heart) NY registered trademark. From my experience it appear that the State of New York is out to lynch anyone who makes a design that remotely resembles the I (heart) NY registered trademark. Thus I will be endeavoring to distinguish my heart designs from the I (heart) NY registered trademark, a design which certainly is so well known of a worldwide level, that you would have to be an idiot to confuse it with my art work.

In fact it is my claim that the state of New York's trademark for a heart-flag may be an infringement upon my heart-flag design because I was the first person to produce a heart-flag and copyright it after 9/11 and therefore have a right to ALL heart-flag variations. Of course I am honored that others would think my heart-flag designs are so good that they would adopt the idea and use it to promote the patriotic spirit in America. So I'm certainly not going to make a claim that I own all heart-flag designs as I encourage everyone to make their own heart
However, this does illustrate the absurdity of making a claim to own all variations of a particular heart design. What I own is only those specific original heart

After getting a good look at this logo it reaffirms my position that this logo is a far cry from any of my much more creative, imaginative and enlightening heart theme designs. A review of the CMG store shows the "I (heart) NY" logo featured on tote bags, bells, address books, hats, pens, steel mugs, stickers, T-shirts and even golf balls! Obviously these folk are a competitor, have an agreement to be the exclusive licensing agent with respect to usage of the "I
But review of the CMG site clearly demonstrates to me why this company would object to my heart theme designs. If my designs had the financial backing of a city and state the size of New York, it would put these folk out of business. Humm, that's an idea. Perhaps I should offer my heart theme designs to every other state in the nation and become the official licensing agent for the entire rest of the nation! Heart Designs: How to make original, attractive, inspirational heart designs.

Then use PhotoShop, PhotoSuite or other graphics programs to add type fonts, slogans, watermarks and to produce an original, attractive, inspirational heart design.

This will establish the design as your own original creation. You may also register your design with the USPTO or simply print out a copy and mail it to yourself. Then you will have a copy of the design in an envelope postmarked by the US Postal Service, a branch of the government, to establish the date you created your design should this ever be contested. If you make many designs and design theme variations like I do you can post copies of all these designs to yourself on a regular basis to establish your ownership. But do not open the envelope. Keep it sealed so it can be opened in court to prove that your designs belong to you.

After 9/11 the Support America campaign site became more popular and I produced a number of new heart and flag designs, including heart and flag combinations and variations.

In fact I've seen at least one case of a flag-heart design produced on products by a company in China and marketed in record stores in America. Talk about infringement, that is definitely a prime case. Boy, I sure would like it if CGM World Wide or someone would represent me in this regard and collect the large sums of money that I could probably get for this copyright infringement!
designs. I also produced heart-flags inside ellipses. This grew out of a request someone made for me to put a logo I made for them inside an ellipse. The result looked so good and fit on certain products CafePress.com offered, that I decided to make a few heart-flag designs inscribed inside an ellipse for the Support America campaign. NY trademark. I do not like that particular amateurish design and would never use it for anything, nor have it licensed to put on product photographs, posters, postcards or other merchandise. My own heart

But it must be done with the understanding that I create my own, unique, original designs from scratch, that my designs belong solely to me, that my designs are NOT an infringement upon anyone else's copyright and/or trademark, and that if my designs are used and marketed and any claim of infringement is made, those who make the claim and who have seen my designs and/or purchased, licensed or used them in anyway agree to pay all my attorney fees and assume all liability with respect to any matters related to usage of my original heart

NY" logo pops up that you have to watch while the page loads a 30 second flash slide video of New York scenes. I would have preferred a fast loading directory homepage with an index rather than wait for this advertisement. However the site does have a lot of good content and information about New York state. And there are even some good freebies, if you don't mind the out-dated, over killed "I

NY" logo. You can also get screensavers featuring New York and the "I
NY" logo. It seems this dull, rather drab logo has been put on everything, even e-postcards which also feature New York scenes. And wouldn't you know it, they even put "I
NY" on their license plates! These folk can take good photographs but their design department seems to be brain dead when it comes to making creative variations of the "I
NY" trademark. Ah, could it be they only own ONE absolute rendering of type style and heart design? When I was at t he USPTO site I also saw they had an "I (heart-flag) NY trademark that was registered after 9/11. I'm sure glad they didn't take my heart-flag off the Internet! I browsed this official "I
NY" site until about 04:00 hrs on the morning of 11 January, 2003 which convinced me that even NYDED does not make significant variations of its own registered trademark. They just use it on photographs and other merchandise. So they certainly do NOT own all possible variations of what can be produced using the idea of a heart, "I Love You" and the state of New York. This gives creative artists and writers great opportunity to make new and potentially popular designs. I'm even thinking now of registering some of my unique "I Love New York" heart designs to prove that this can be done. In fact maybe I will make about 100 variations and try to register them all at once, or at least put them on file with the USPTO as copyrighted designs.

However, before marketing any of my designs which might raise the eyebrows of CMG, I will certainly seriously consider getting registered trademarks of my own designs. I will, in essence, let the USPTO decide if my heart theme designs conflict with the existing trademark registration owned by the New York Department of Economic Development and represented by CMG Worldwide. Plus I might also make a CMG business inquiry just to see what these people have to say. Who knows they might like my original heart theme designs so much that they want to hire me to do a whole new line of products for them and/or represent me with respect to my own heart theme designs, those that they do not perceive as being in conflict with the "I
