This is a small business license and agreement between The Artist and the winner of this auction or buyer, The Licensee, an individual and/or small business or home business operator. This license is not transferrable and is made only to the individual and/or small business or home business operator who pays for the license.
You are bidding on and/or buying the license to use an original, unique design creation by The Artist. This design was made from scratch beginning with a blank piece of paper, canvas or screen. All the component parts of the design were drawn, produced, assembled or otherwise constructed and/or created by The Artist who may have used current events, historical events, politics, POP culture, television, movies, music, dance or other experiences for inspiration.
Similar designs have been test marketed on products and resulted in tens of thousands of dollars in merchandise being sold. There is no limit to the potential profit you can make with this design which may be reproduced upon hundreds of products using silk screen printing, heat transfer or other mass production methods. Once you license this design you may reproduce the licensed design upon t-shirts, jerseys, sweatshirts, cups, caps, mugs, mouse pads or any other appearl or merchandise. This makes an attractive design item that has real potential for making great profit!
Please note that to The Artists knowledge and belief the usage of this design does not violate any copyrights as the design is the original, unique creation of The Artist. You are purchasing a license to use this design; the copyright of this design remains the property of The Artist. This is similar to how sports teams and universities license their logos and mascots to businesses for reproduction upon merchandise, and is a perfectly legal process. When you license this design you may keep all the profits from the marketing of any merchandise; no royalty fee from each item sold is required. All you pay is the initial license fee through this auction and/or service. You may use this design indefinitely; there is no time limit for this license; hence, the value of this license and the potential to make great profit over time is extremely high which is why The Artist seeks a premium price and return for the usage of this design.
Please note that you will be provided with an original full color graphic file of the design you license. This design will be free of any "SAMPLE" markings which are shown on designs for security purposes only. You may make copies of this graphic file and provide copies to businesses that said design may be mass produced for marketing upon products. But you may not alter the design in any way, shape or form; also you may not resell this license to a third party; this design may only be licensed by The Artist and/or copyright owner. You must license EACH INDIVIDUAL DESIGN separately; if you license one design from The Artist you do not have permission to use other designs created by The Artist unless and until you make a purchase of a license to use each design. Each and every design has a design number and the license you purchase is only for the specific design number you purchase and does not apply to or transfer over to any other design.
When you license this design you release The Artist, his agent and/or representative from any and all liability whatsoever with respect to this design, its usage and/or reproduction and agree to hold the artist harmless in all regards with respect to the usage of this design, its license, reproduction, marketing and/or distribution upon any and all forms of merchandise.
All sales are final and no refunds can be made given once you have copy of the master graphic design file it is impossible for the artist to know that you will not use said design. It is understood that when you license this design and pay the license fees that you may use this design and market any type of products with this particular design. You do not purchase any exclusive rights, any territorial or regional right or any other rights beyond the right to be able to reproduce this design and market it upon products. For example, you may open a shop on CafePress.com and market this design on products. You may have a private silk screen printer reproduce this item on merchandise and market it is stores, at art and craft fairs or through other commercial outlets. You may even resale items you have produced with this licensed design upon eBay or other similar services. The potential profits you may therefore make over time are enormous!
To The Artist's knowledge, no registered trademarks, images of celebrities or preexisting art work or designs were used in the creation of this original design. It is the understanding of The Artist that this is an original, unique design of his own creation; that this design does not violate any trademarks and may be reproduced and marketed upon merchandise without restriction; however, The Artist is not a lawyer and has not researched trademarks. The licensee assumes all responsibility with regard to usage of this design item.
As the licensee you assume full responsibility for how the design is used and/or marketed. The artist retains the right to license this design to anyone else and the purchase of this license does not come with any guarantees or promises that it will make you rich or be a popular item. However, similar designs have been test marketed and been found to be popular so it is very probably that you will be able to use this licensed design to make much more than it will cost you to license the design. Any and all costs, expenses, liabilities or other problems you may have with marketing design items using this licensed design are yours and yours alone, not The Artist's. This license may NOT be transferred by deed, will or any other conveyance whatsoever. The Artist reserves the right to cancel this license at any time should the licensee violate the terms of this agreement. No refund will be made for cancellation of this license and the licensee agrees to pay any legal fees and/or other damages for any violation of the terms of this license and agreement.
This is an individual license for small businesses and/or home businesses. If you are major corporation like Wal-Mart, Kmart, Sears or other major corporation you must purchase a commercial license which will include a royalty upon all items sold, given said major distrubutors mass market items nationally and internationally. Please contact The Artist if you plan to mass market any design item through a major retail store or chain. The Artist also has hundreds of additional designs that may be licensed by individuals and/or small businesses or home businesses owners.
